Privacy policy

ParaQuad NSW complies with the National Privacy Principles (NPP) established under the Privacy Amendment (Private Sector) Act 2001.

ParaQuad's commitment to your privacy

1. ParaQuad's commitment to privacy
The Paraplegic and Quadriplegic Association of NSW (ParaQuad) abides by the National Privacy Principles (NPP) established under the Privacy Amendment (Private Sector) Act 2001. To view the NPP, please contact ParaQuad on 02 8741 5600 or visit our website at www.paraquad.org.au and follow the links.
2. Collection of personal and sensitive information
ParaQuad collects personal information which is necessary to conduct its direct marketing activities, its provision of a health service, and its mailings and communications to its members. To undertake these activities, the information we obtain and hold is detailed and personally identifies you and/or contains information or an opinion about you. To enable ParaQuad to undertake its nursing and occupational therapy activities, we need to obtain sensitive information about you, such as medical details and history.
3. The consequences of not providing requested information
We need to collect the information to provide you with an effective service. If you choose not to provide us with the personal or sensitive information mentioned above, we may not provide you with our services if we believe we cannot provide you with an adequate service. Not providing us with the personal information referred to above may affect the adequacy or appropriateness of the service we provide to you.
4. Information collection procedures

Collection of your personal information will usually take place in face-to-face interviews, over the telephone or with a client engagement form. From time to time additional and/or updated personal information may be collected through one or more of these methods.
We only collect any personal information about you when you have consciously provided that information to us, or authorised another agent to provide that information to us. We will gain a commitment in writing from the other agent that they have abided by the NPP in collecting that information.
We will only collect, maintain and use personal information about you if it is necessary for us to provide you with the services you have requested.

These services include:

nursing services and advice;
occupational therapy;
personal care;
accommodation; and
membership services.
5. Using and disclosing your personal information

We will not use or disclose personal information we collect for any purpose other than:

the purposes for which it was provided; or
where you have consented to such disclosure; or
where the NPP authorise use or disclosure where required or authorised under law, in circumstances relating to public health and safety and in connection with certain operations by or on behalf of an enforcement body.

We will only disclose health information about you if the disclosure is necessary for research, or the compilation or analysis of statistics, relevant to public health and public safety and we will only do so if:

it is impractical for us to seek your consent before the use or disclosure;
the use or disclosure is conducted in accordance with guidelines approved by the Commissioner under section 95A of the Privacy Act;
in the case of disclosure - we reasonably believe that the recipient of the healt information will not disclose the health information, or personal information derived from the health information.

We may use personal information collected from you for the purpose of providing you with direct marketing material. You may request not to receive that information by contacting ParaQuad. We will respect your request.

We may disclose your personal information to external contractors for an audit of ParaQuad accounts. We will ensure that contractors we engage comply with the NPP in their handling of your personal information.

6. Information storage and security practices

ParaQuad will keep the information we hold about you secure. We will also keep the information up to date. Personal information about you is stored on secure computers or in controlled facilities. Our paper files which contain your personal or sensitive information are stored in lockable cabinets which are locked out of hours.

When you cease to be a client of our health service or a member, we will destroy the information we hold about you. We are required by law to keep your health and medical records for seven years. During this time they will be kept secure in lockable cabinets and they will be destroyed after the seven year period.

7. Gaining access to your personal information

ParaQuad will provide you with access to all the records we hold about you either by providing you with copies of the information you request or allow you to personally inspect your records. We will not provide you access to your records if:

providing access would pose a serious threat to the life or health of a person;
providing access would have an unreasonable effect upon the privacy of others;
the request for information is frivolous or vexatious;
the information related to existing or anticipated legal proceedings between us and would not be discoverable in those proceedings;
providing access would reveal the intentions of ParaQuad in relations to negotiations with the individual in such a way as to prejudice those negotiations;
providing access is required or authorised by or under law;
providing access would be likely to prejudice certain operations by or on behalf of an enforcement body or an enforcement body requests that access be denied on the grounds of national security.
providing access would be likely to prejudice:
the prevention, detection, investigation, prosecution or punishment of criminal offences, breaches of a law imposing a penalty or sanction or breaches of a prescribed law
the enforcement of laws relating to the confiscation of the proceeds of crime
the protection of the public revenue
the prevention, detection, investigation or remedying of seriously improper conduct or prescribed conduct
the preparation for, or the conduct of, proceedings before any court or tribunal or implementation of its orders by or on behalf of an enforcement body;
an enforcement body providing a lawful security function asks ParaQuad not to provide access to the information on the basis that providing access would be likely to cause damage to the security of Australia.

If we decide to deny you with access to the information we hold about you for any of the above reasons, we will provide you with an explanation for doing so.

If providing access to you would reveal evaluative information generated within ParaQuad in connection with a commercially sensitive decision-making process, we may give you an explanation for the commercially sensitive decision rather than direct access to the information.

8. Correction of your personal information

ParaQuad will take all reasonable steps to ensure the personal information we hold about you is kept up to date and accurate. If you believe, and you can establish the information we hold about you is not correct, we will take reasonable steps to correct the information.

If you disagree with ParaQuad about whether the information we hold about you is accurate, complete and up to date, on your request we will take reasonable steps to associate the information with a statement from you claiming the information is not accurate, complete and up to date.

If we refuse to correct the information we hold about you, we will provide you with reasons.

9. Emails, website and electronic communications

On visiting our site our website hosting provider makes a record of your visit and logs the following information for statistical purposes:

The IP address;
The user's top level domain name;
The date and time of your visits to the site;
The pages accessed, the previous site visited and the type of browser used.

No attempt will be made to identify users or their browsing activities except, in the event of an investigation where a law enforcement agency may exercise a warrant to inspect the website hosting provider's logs. Our Internet service provider operates a secure, encrypted server to ensure any
details about users cannot be intercepted or observed by others.

We will only record your e-mail address if you send us a message. It will only be used for the purpose for which you have provided it and will not be added to a mailing list. We will not use your e-mail address for any other purpose and will not disclose it without your consent. No personal information is stored directly on our public web server.

10. What to do if you have a problem or question
If you have any questions relating to our privacy policy, or a problem or complaint, please contact ParaQuad's Privacy Officer by calling 02 8741 5600. Alternatively you may contact the Federal Privacy Commission. If you haven't already contacted ParaQuad first, the Commission will refer you back to us.
11. Future changes

From time to time our policies may be reviewed and revised. ParaQuad reserves the right to change its privacy policy according to any change of the law. If we do this we will notify you by posting an updated version of the policy to our website and by informing you through our journal, ParaQuad News, or when we have contact with you.

12. ParaQuad NSW Certifications

AS/NZS ISO 9001 Quality Management System

ParaQuad NSW is certified to AS/NZS ISO 9001 Quality Management System covering the supply of continence and associated skin and wound care products.

This Quality System provides a framework of policies and procedures, including:

  • Management Responsibility
  • Resource Management
  • Customer and Client Related Processes
  • Document and Records Management
  • Measurement, Analysis and Continuous Improvement including Internal Audits
  • Preventive and Corrective Actions

The Quality System is registered by SAI Global who conducts annual systems audits to ensure compliance to the ISO 9001 standard and to confirm continuous improvement initiatives are established and operating effectively.

Disability Services (Disability Employment and Rehabilitation Program) Standards 2002

ParaQuad NSW is certified to the Disability Services (Disability Employment and Rehabilitation Program) Standards 2002.

This certification covers the Disability Services Management System for the provision of employment services, including personalized support services to people with a physical disability in a supported employment environment and is administered through the Department of Family and Community Services.

The Disability Employment and Rehabilitation Program is registered by SAI Global who conducts annual systems audits to ensure compliance to the Disability Services Standards 2002 and to confirm continuous improvement initiatives are established and operating effectively
